1. Registrant and ownership

1.1 Domain names are registered in the name of the Customer, or another legal entity the Customer nominates, unless the parties agree otherwise in writing. MAITS may act as the technical or administrative contact.

1.2 The Customer is responsible for:

  • the accuracy of registrant information;
  • eligibility to hold the name; and
  • ensuring that the name does not infringe another person's rights.

2. Acquisition

2.1 MAITS acquires a domain name only after the Customer has accepted a quotation for it and the payment arrangements are in place. MAITS never purchases a domain name automatically.

2.2 A name is not available until the registry confirms its registration. MAITS is not liable if a name becomes unavailable before registration.

3. Registry rules

3.1 Domain names are subject to the rules of the relevant registry and registrar, including the .nz policies of the Domain Name Commission and auDA's rules for .au names. Those rules prevail over these terms.

3.2 MAITS is not responsible for registry or registrar decisions, disputes, suspensions or fee changes.

4. Records

4.1 MAITS records and shows in the Portal:

  • the registrar;
  • the registrant;
  • the registration and expiry dates;
  • the renewal method;
  • the managing party; and
  • the related Order and invoice.

A name is shown as "Registered" only after the registrar has confirmed the registration.

5. Renewal

5.1 Renewals are invoiced before expiry. A name may lapse under registry rules if:

  • the renewal is unpaid;
  • registrant information is incorrect; or
  • the Customer asks MAITS not to renew it.

MAITS is not liable for a lapse caused by non-payment or by the Customer's instructions.

6. Disputes over names

6.1 Disputes about the right to a domain name, including dispute resolution under registry policies, are between the registrant and the other party. MAITS may assist at its rates.

7. Transfer

7.1 On request, MAITS will provide the authorisation code and reasonable assistance to transfer a name to the registrant's chosen registrar, within 5 Business Days, once all amounts owed for that name have been paid.
